These terms govern your use of Halo, an electronic medical record platform operated by WhiteWater Development LLC ("WhiteWater," "we," "us," or "our"). Halo is used by healthcare providers to deliver care and by their patients to access it. By creating an account or using Halo, you agree to these terms.

1. Halo is software, not a medical provider

Halo is an electronic medical record platform. Clinical care is provided by the licensed healthcare providers who use Halo, not by WhiteWater Development LLC. Nothing in Halo is medical advice, and using the platform does not create a provider-patient relationship with us.

2. Not for emergencies

Halo is not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use portal messaging to report urgent or emergency symptoms.

3. Eligibility and accounts

You must be at least 18 years old to create an account, or have a parent or legal guardian create and manage an account on your behalf. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity that occurs under your account, and you should notify us promptly if you suspect unauthorized access.

4. Acceptable use

You agree not to:

  • Use Halo for any unlawful purpose;
  • Access or attempt to access information you are not authorized to view;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the platform or its underlying systems;
  • Upload malicious code or content that is unlawful, harassing, or infringing.

5. Communications and consent

By providing your email address and phone number, you consent to receive appointment reminders, account notifications, and other messages related to your use of Halo. Message and data rates may apply. You can adjust certain notification preferences in the portal; transactional and care-related messages may be required to use the platform.

6. Privacy and health information

Your use of Halo is also governed by our Privacy Policy, which describes how information, including protected health information, is collected, used, disclosed, and safeguarded, and lists the third-party service providers that help operate the platform.

7. Fees and payment

Fees for Halo and for services delivered through it are described at the time of purchase or in a separate agreement with the healthcare provider or practice. Payments are processed by our third-party payment processor; we do not store full payment card numbers.

8. Intellectual property

Halo, including its software, design, and content (excluding medical records and data entered by users), is owned by WhiteWater Development LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the platform in accordance with these terms.

9. Disclaimers and limitation of liability

Halois provided "as is" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the platform will be uninterrupted or error-free. To the maximum extent permitted by law, WhiteWater Development LLC is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Nothing in these terms limits liability that cannot be limited under applicable law, and these terms do not limit your rights regarding the clinical care you receive from your provider.

10. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice within the platform. Continued use after changes take effect constitutes acceptance of the updated terms.
